Movement "For Freedom!" accuses court of counterstanding to rendering legal assistance
Suppoters of the Movement "For Freedom!" accuse the court in counterstanding to rendering legal assistance. A corresponding complaint has been filed to Brest regional court. The complainants claim the decision of the Leninski district court of Brest to deny them in intiating of case with regard to selling of a residential building which has the status of national historical and cultural value, to the citizen of the Russian Federation.
The coordinator of the Movement "For Freedom!" in Brest Dzianis Turchaniak explained to the European Radio for Belarus that the bargain had been made by Brest communal services and the Russian citizen Burnos at the auction conducted by Brest city executive committee.
The activists of the movement are convinced that the above bargain breaks the right of Belarusian people for historical and cultural heritage, and will do their best so it is considered illegal. A status building in the center of Brest could not be set for an auction without the consent of the Ministry of Culture, explained Dzianis Turchaniak.
The first instance court refused to initiate the case on the ground that a public association like the Movement "For Freedom!" cannot file a claim on considering a bargain illegal.
"It turns out that only public prosecution and state authorities can render legal assistance to citizens in court. But what if it's the State which breaks the law? We have a close circle here" - says Dzianis Turchaniak.
It is clearly stated in the Constitution of the Republic of Belarus that no one should counterstand to rendering legal assistance. Dzianis Turchaniak explained that "For Freedom!" activists wanted to render legal assistance to those who suffered from illegal transfer of property rights, in the court.
